Terms and Conditions
1. Account Terms:
Strictly Nett thirty day account.
2. Quantity Variations:
A shortage or surplus not exceeding ten per cent, charged pro-rata, may be necessary in order to facilitate packing in a way which minimises the risk of damage in transit and this will be considered due execution of any order. To this end full cartons are despatched wherever possible.
3. Claims:
Any Claim for damage or shortage must be made within three days of receipt of goods.
4. Retention of Property:
4.1 The Goods shall be at the Buyer's risk as from delivery.
4.2 In spite of delivery having been made property in the Goods shall not pass from the Seller until:
4.2.1 the Buyer shall have paid the Price plus V.A.T. in full; and
4.2.2 no other sums whatever shall be due from the Buyer to the Seller.
4.3 Until property in the Goods passes to the Buyer in accordance with clause (4.2) the Buyer shall hold the Goods and each of them on a fiduciary basis as bailee for the Seller. The Buyer shall store the Goods (at no cost to the Seller) separately from all other goods in its possession and marked in such a way that they are clearly identified as the Seller's property.
4.4 Notwithstanding that the Goods (or any of them) remain the property of the Seller the Buyer may sell or use the Goods in the ordinary course of the Buyer's business at full market value for the account of the Seller. Any such sale or dealing shall be a sale or use of the Seller's property by the Buyer on the Buyer's own behalf and the Buyer shall deal as principal when making such sales or dealings. Until property in the Goods passes from the Seller the entire proceeds of the sale or otherwise of the Goods shall be held in trust for the Seller and shall not be mixed with other money or paid into any overdrawn bank account and shall be at all material times identified as the Seller's money.
4.5 The Seller shall be entitled to recover the Price (plus V.A.T.) notwithstanding that property in any of the Goods has not passed from the Seller.
4.6 Until such time as property in the Goods passes from the Seller the Buyer shall upon request deliver up such of the Goods as have not ceased to be in existence or resold to the Seller. If the Buyer fails to do so the Seller may enter upon any premises owned occupied or controlled by the Buyer where the Goods are situated and repossess the Goods. On the making of such request the rights of the Buyer under clause (4.4) shall cease.
4.7 The Buyer shall not pledge or in any way charge by way of security for any indebtedness any of the Goods that are the property of the Seller. Without prejudice to the other rights of the Seller, if the Buyer does so all sums whatever owing by the Buyer to the Seller shall forthwith become due and payable.
4.8 The Buyer shall insure and keep insured the Goods to the full price against 'all risks' to the reasonable satisfaction of the Seller until the date that property in the Goods passes from the Seller and shall whenever requested by the Seller produce a copy of the policy of insurance. Without prejudice to the other rights of the Seller, if the Buyer fails to do so all sums whatever owing by the Buyer to the Seller shall forthwith become due and payable.
The Buyer shall promptly deliver the prescribed particulars of this contract to the Registrar in accordance with the Companies Act 1985 Part XII as amended. Without prejudice to the other rights of the Seller, if the Buyer fails to do so all sums whatever owing by the Buyer to the Seller shall forthwith become due and payable.
Bad Debts: The Seller understands and will exercise the Seller's statutory right to claim from the Buyer interest and compensation for debt recovery costs under the late payment legislation if the Seller is not paid according to the agreed credit terms.
Access: We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Your access to the website may occasionally be suspended or restricted to allow for repairs, maintenance, or for the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. In return, you must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way.
Contract: When you press the 'submit' button, you are entering into a legally binding contract of sale with R.D. Haigh & Co. and you agree to all the Terms and Conditions as stated herein. Any changes that you want to make to your order after it has been submitted must be made in writing by e-mail. The Contract will be governed by the laws of England and Wales and the parties to the Contract submit to the jurisdiction of the English Courts.

Delivery.
We pride ourselves on our rapid service and aim to despatch all orders promptly; you should normally receive your order within five working days. If for some reason your parcel doesn't arrive within 10 working days, please contact us. Whilst we make every effort to ensure that all items shown are in stock, we offer no guarantee of availability and this electronic publication does not constitute an offer for sale.
For standard delivery, parcels under 4 Kg will be delivered by Royal Mail. Parcels over 4 Kg will, depending on size and weight, be delivered by ParcelForce 48-hour service, APC or UPS, and will require a signature on delivery. If in any doubt about the condition of a delivery, sign for the delivery as "unexamined". If the box is obviously damaged, sign for the delivery as "box damaged". If you are not in when the delivery arrives, parcels can only be left with a neighbour or in another location if you give instructions at the time of ordering. If your order specifies that delivered goods are to be left without a signature, then R.D. Haigh & Co. cannot be held responsible for items that are subsequently found to be damaged or missing. If you request delivery on a particular date, we will do our best to meet your request. If there is no-one in to receive the item, and no alternative delivery instructions have been given, a card will be left for you to arrange re-delivery with the carrier.
Standard deliveries are made Monday to Friday, excluding Bank Holidays, between 8 a.m. and 6 p.m.,
Premium delivery services, e.g. next working day, next working day before noon, next working day before 10 a.m., next working day before 9 a.m. or Saturday delivery, are all available (except to the Highlands and Islands of Scotland) for an additional charge.
Any applicable shipping costs are calculated at the checkout stage prior to payment being taken. Overseas prices are ex-works and the delivery charges quoted on this website are only intended as a guide. We reserve the right to modify charges should they be significantly different from those quoted, although we will always inform you should this be necessary.
There is no minimum order value, but please log in to see the carriage-paid order value applicable to your account.
Indemnity: You agree to indemnify us against any claims, losses, liabilities, damages and expenses (including legal fees), arising out of your use of this site.
Licence: R.D. Haigh & Co. grants you a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of R.D. Payment:
Existing customers may have their orders invoiced to their account or they may pay by card at the time of ordering. New customers must pay for their first order by card at the time of ordering. If, for any reason, your payment is not authorised by your card issuer, then we will be unable to accept your order. Cards issued by overseas banks will be debited in Sterling and converted into the currency of the card account by the card issuer. Exchange rates given on this website are for guidance only and the actual exchange rate used for the transaction will be determined by the card issuer.

Prices and Tax: This is a trade only web site and prices are only visible to registered trade customers. The prices displayed are trade prices and are in Sterling and exclusive of V.A.T. Prices are not subject to V.A.T. for export customers, with the exception of customers in the E.U. who are not registered for V.A.T. or who do not provide us with their V.A.T. registration number. Please note that orders from customers outside the E.U. may be subject to import duties and taxes, which are levied once the package reaches its destination. Any additional charges for customs clearance must be borne by the customer; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from us, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.
Privacy Policy: Personal information is private so, we treat it with the highest standards of security and confidentiality in accordance with the Data Protection Act. We never disclose any information that we hold about you to any third party, other than for delivery purposes. You can rest assured that your credit or debit card details and personal information are safe with us. Customers may be sent our own company information from time to time. If you do not wish to receive literature from us, then please notify us by e-mail and you will be removed from our mailing list.
Product Availability: Our web site is regularly updated. Whilst we make every effort to ensure that all items shown are in stock, we cannot guarantee availability and this electronic publication does not constitute an offer for sale. It may occasionally happen that an item is out of stock and, if this is the case, we will contact you as soon as possible with an estimate of how long it will be before the item is available. You may then cancel the item, choose an alternative item, or wait for the item to be available and we will send it on to you as soon as possible. We reserve the right to withdraw any item from sale, at any point prior to despatch, for whatever reason. You will be promptly informed if such a situation arises.
Product Specification: Whilst we make every effort to give accurate and up-to-date information, product specifications and measurements may vary slightly from those stated. All dimensions are approximate and subject to slight variation. Product photographs are for illustration only and products may vary slightly from those shown. Every effort is made to reproduce colours accurately, but there may be slight colour differences in reproduction. Some products are hand-made from natural materials and therefore some variation may occur with these items. Security: When an order is placed at our website, card payment information is submitted via the WorldPay secure cardholder payment interface, which is fully compliant with the Payment Card Industry Data Security Standard (PCI DSS). The WorldPay payment system uses a combination of both established and innovative techniques to ensure the security and integrity of all sensitive data. Furthermore, the WorldPay public web servers are certified by Thawte, a public certificate authority, ensuring that both the buyer and seller can have confidence that nobody can impersonate WorldPay to obtain confidential information. The payment information is encapsulated using WorldPay's own encrypted and digitally-signed protocol; this uses a combination of standard methods such as PGP, RSA and MD5 to ensure that the information passed is secure and tamper-proof. Data storage on WorldPay systems, and the communication between WorldPay and the worldwide banking networks, is regularly audited by the banking authorities to ensure a secure transaction environment. WorldPay also ensures that it stays up-to-date with the latest versions of any third-party code that they use and they continually review their own proprietary code. R.D. Haigh & Co. does not have access to your payment information, nor is it held in clear text on any web site.
